The Site “https://blog.servier.fr” has been designed and produced by Exit 9, SARL (SIRET [business registration number]: 517 900 494 00017), a limited liability company with a share capital of 6000 Euros, registered with the Trade and Companies’ Register of Nanterre under number 515 900 494, the head office of which is located at 48, rue Meslay – 75003 Paris – France.
3. Intellectual property
The User acknowledges that all content available on the Site including, but not limited to, the text, graphics, photographs, designs, sounds, data, images, audio, video, in addition to the Site’s structure, navigation plan, logos, section design, section layout, section headings, databases, database structure and content, trademarks (hereinafter referred to as “Content”) are the exclusive property of LES LABORATOIRES SERVIER.
The Content is intended for the User’s personal information only and within the strict limits of use of the Site in accordance with the present Terms. Any other form of use of the Content by any means whatsoever without the prior and express authorisation of LES LABORATOIRES SERVIER is forbidden and would constitute an infringement.
The trademarks of SERVIER and its partners, as well as the logos displayed on the Site are registered trademarks. Any reproduction, in whole, or in part, of these trademarks or logos, using components taken from the Site without the prior and express authorisation of their holders is prohibited.
The User undertakes to use the Site:
- for its intended purpose;
- for personal use to the exclusion of all commercial or promotional activity;
- in compliance with copyright;
- without using bots or any other automated means to access and use its content, and without attempting to interfere with the Site;
- without attempting to copy it, reproduce it in whole or in part, render it accessible or disseminate it by any means to unauthorised third parties.
4. Personal data
LES LABORATOIRES SERVIER is responsible for the processing, within the meaning of French act no. 78-17 of 6 January 1978 relating to Information Technology, Data Files and Civil Liberties (so-called French “Data Protection” act) amended in 2004, of the User’s personal data collected and processed as part of the administration of Site Users and the post-moderation of their comments.
Access to the “comment” facility offered by the Site requires User identification. Any Internet user wishing to comment on articles published on the Site is required to create an account or identify himself or herself by logging in via his or her Facebook, Twitter, LinkedIn or Google+ account.
Any User creating an account on the Site in order to access the “comment” facility represents and warrants that he or she is at least 18 years of age.
In the absence of the technical possibility of verifying the age of Users, it is the responsibility of each User to have in place adequate security measures to protect and restrict the access of minors to the Site.
Each comment submitted by the User to the Site will be signed by his or her profile login ID. As such, the User is informed that he or she has the possibility to select a pseudonym in order to protect his or her privacy on the Site. The comment spaces are intended to enable the User to submit contributions to the proposed discussion topics and he or she is informed that any data contained in those contributions (especially e-mail addresses and/or contact details) cannot be collected or used for other purposes without his or her consent.
The User can request the deletion of his or her comments at any time by contacting us at the address provided on the Site’s homepage.
The User is informed that his or her personal data are intended for the services and personnel of LES LABORATOIRES SERVIER responsible for administration of the present Site and moderation of the comment spaces. The companies OVH and Exit 9, in charge of hosting and producing the Site, respectively, may be required to access the personal data of Users for purposes strictly necessary for the performance of their duties.
The User acknowledges and accepts that his or her account will be deactivated after a two-year period starting from the User’s last connection to his or her account.

5. Moderation and respect of the participation rules
5.1 Assignment of User rights
Each User assigns to LES LABORATOIRES SERVIER, which accepts it, the right to use and exploit the free contributions that he or she submits to the Site through the “comment” facility. As such, LES LABORATOIRES SERVIER undertakes not to distort the content of the free contributions and undertakes to exploit them in strict compliance with the Site’s editorial line.
The rights are thus assigned by the User to LES LABORATOIRES SERVIER on a worldwide basis, for the full period of the legal protection of copyright and on all paper, digital, electronic and audiovisual media.
5.2 User commitment
The Site’s services and content including the User’s contributions are for the Users’ personal use and cannot be used for the benefit of a company or any other organisation, or for professional, promotional, marketing or commercial purposes.
As a general rule, the User shall refrain, via his or her contributions to the Site, from promoting or advertising an organisation, company, product or service, whether or not it is marketed by LES LABORATOIRES SERVIER.
When using the Site the User shall respect the applicable legislation and in particular the provisions relating to the protection of privacy and personal data.
The User shall especially refrain from any collection or any misuse of personal information to which he or she accesses and, as a general rule, he or she shall refrain from acts likely to damage the privacy, reputation, esteem, image or sensitivity of another User or any other individual, by avoiding defamatory, provocative, malicious or threatening statements, messages or text.
Comments in violation of the law will be deleted with no prior warning to their author.
Free contributions by Users on the Site shall under no circumstances comprise content including, but not limited to, subject matter:
- of a pornographic or paedophilic nature;
- inciting violence, discrimination, or hatred;
- of a racist, xenophobic, sexist, homophobic, or revisionist nature;
- inciting smoking, consumption of alcohol or consumption of substances prohibited by law;
- inciting acts of computer piracy or acts to circumvent technological protection measures or intellectual property rights information;
- inciting (or depicting) cruelty to animals;
- that is harmful to minors, their image, their privacy, or the protection of children and adolescents;
- that runs counter to the Convention on the Rights of the Child;
- that is susceptible to undermine the respect of privacy, the respect of the human person and human dignity, or male-female equality;
- that infringes copyright or related rights, rights applicable to databases, right of personal portrayal, respect of privacy, protection of personal data, or which would infringe any other currently-applicable legal or regulatory provisions;
- that infringes regulations in terms of the marketing or promotion of healthcare products or services.
The User undertakes to behave with courtesy and respect the opinions of others. The editorial team reserves the right to remove posts that:
- are off-topic;
- are aggressive, vulgar, or take the form of direct attacks or insults between users;
- are personal attacks on one or more members of SERVIER or the editorial team;
- criticise the moderation;
- are of a promotional or advertising nature;
- appeal for witnesses in relation with products or services or to participate in broadcasts or events;
- contain personal contact information;
- criticise or could harm the image of SERVIER.
5.3 Post moderation
LES LABORATOIRES SERVIER post-moderates contributions freely and automatically/directly disseminated on the Site by Users via the “comment” facility with neither prior editorial verification nor prior fixation in material form.
Each User is informed and accepts that all messages and content posted on the Site are public communications subject to all currently-applicable regulations and, as a consequence, incur his or her liability.
LES LABORATOIRES SERVIER shall not be held liable for messages, comments and content thus issued by the User.
The User is individually liable for the content of his or her messages and comments irrespective of the nature, subject and purpose.
Post-moderation is performed in strict compliance with the provisions of French act no. 2004-575 of 21 June 2004 relating to Trust in the Digital Economy.
In that respect, the User acknowledges that LES LABORATOIRES SERVIER assumes only the responsibility of technical intermediary as defined in article 6 I 2 of the French Trust in the Digital Economy act regarding content freely-produced by Users, and as such the User acknowledges that:
- LES LABORATOIRES SERVIER cannot in any way be held liable for the nature, quality and legal compliance of content thus produced by the Users,
- LES LABORATOIRES SERVIER can delete said content if a third party has notified its unlawful nature in accordance with the procedure required for making such a request for deletion,
- LES LABORATOIRES SERVIER shall communicate, on formal request by the Court authorities, elements enabling identification of the Users having contributed to this content.
LES LABORATOIRES SERVIER reserves the right to delete promptly and without warning or indemnity any contributions found to be unlawful, at the request of a third party or of which LES LABORATOIRES SERVIER becomes aware, in particular those in violation of the provisions listed above, the content of which could infringe the rights of third parties.
A contact address is provided on the Site’s homepage for Users, and Internet users in general, to enable them to submit an online notification should they note an infringement of their privacy.
In the event of proven infringement of the notifying party’s privacy, the contentious contribution shall be promptly withdrawn.
LES LABORATOIRES SERVIER provides Users with information relating to the health domain and articles from the specialist press in accordance with the legal and regulatory obligations imposed on pharmaceutical companies and in particular the provisions of the French Public Health Code.
The User is informed that the information published on the Site does not constitute legal or medical advice, and it is particularly recommended not to make decisions based solely on the information contained on this Site.
The User must in no event use information disseminated via the Site to establish a diagnosis or determine treatment, and must consult the competent healthcare professionals responsible for his or her follow-up and care prior to any medical decision.
LES LABORATOIRES SERVIER cannot be held liable for the use made by the User of the information and services proposed on the Site and/or whilst browsing.
It is expressly agreed that LES LABORATOIRES SERVIER is subject to a “best efforts” obligation with respect to the execution of the present Terms and the implementation of the Site, including in particular the completeness, quality, and exhaustiveness of the information and services proposed on it and the continuity of access to the Site.
LES LABORATOIRES SERVIER cannot be held responsible by the User for any direct or indirect damage resulting from browsing the Site, or from the use of or impossibility of using the content, information or services proposed via the Site. Notwithstanding all efforts by LES LABORATOIRES SERVIER and its technical service providers, the User is informed that the reliability of the Internet cannot be guaranteed, especially in terms of security of data transmission, continuity of Site access, performance in terms of the volume and speed of data transmission, and virus propagation.
In all cases, the User acknowledges in particular that the information and services offered on the Site:
- may be interrupted due to events of force majeure or that are beyond LES LABORATOIRES SERVIER’s control or for which LES LABORATOIRES SERVIER is not responsible;
- may contain technical or human errors;
- may result in occasional data loss.

8. General provisions
LES LABORATOIRES SERVIER reserves the right to modify these Terms. The User’s continued browsing and use of the Site constitute acceptance of these modifications.
Should one or more of these Terms become invalid for whatever reason, the other provisions shall remain in full force and effect.
The present Terms are governed by French law in both form and substance.
